1 Definitions
In these Terms and Conditions, unless otherwise specified, the following terms shall have the meanings set out below:
2 Basic Features of the KINGS Card
2.1 The KINGS Card is issued by All In Fintech Limited pursuant to the terms and conditions of 'VISA, Mastercard' and 'UnionPay International', and is sold and/or serviced by the Company.
2.2 The validity period of the KINGS Card is indicated on the card and may be renewed in accordance with these Terms and Conditions.
2.3 The stored value in the KINGS Card is held in the KINGS Account. The stored value in the KINGS Account does not accrue any current interest or returns and is not deemed a deposit with the Company. Any accrued interest or other returns (if any) arising from the stored value (whether before, on, or after the effective date) shall belong to the Company.
3 Application for the KINGS Card
3.1 'KINGS Card' includes virtual and physical KINGS Cards, which can be used for online and offline (physical card only) transactions worldwide, including cash withdrawals at any ATM displaying the VISA, Mastercard, or UnionPay International logo worldwide.
3.2 The 'KINGS Card' requires real-name authentication. The Cardholder must provide all identification documents, information, and supplementary documents requested by the Company. The Cardholder may be required to open an account in person with the Company's staff or through the Company's identity verification system.
3.3 The Company reserves the right to review, process, adjust, approve, or reject any application for the KINGS Card at any time. The Cardholder must provide all relevant documents, proofs, and information as requested by the Company for verification, processing, and approval, with the Company retaining final decision-making authority.
3.4 The Company reserves the right to request the Cardholder to provide additional valid supporting documents and personal information at any time for supplementation, record-keeping, risk assessment, and approval purposes. All documents and information must be clear, complete, true, and valid.
3.5 The Company reserves the right to reduce or increase the asset limit or service scope of the KINGS Card at any time, and to suspend or cancel the KINGS Card at any time without providing any reason to the Cardholder.
3.6 Different types of KINGS Cards have different usage scopes and limits (for details, refer to the Fee Schedule). Before using the KINGS Card, the Cardholder shall clearly understand its usage scope, limits, fees, risks, and liabilities, and make a choice based on their own needs and risk tolerance.
3.7 Identity Verification, Fees, and Account Termination
3.7.1 Identity verification is a mandatory prerequisite for opening a KINGS Card Account. The Cardholder must provide real, valid, and complete identification documents and personal information as requested by the Company to complete verification. The Company reserves the right to decide whether to approve the application based on the verification results.
3.7.2 Card Opening Fees are Non-Refundable: Successfully submitting a KINGS Card application is deemed as confirmation of purchase intent. Once the KINGS Card is successfully opened, any card opening fees paid (also referred to as production fees or initial issuance fees) are non-refundable, regardless of whether the Cardholder activates or uses the card. This fee is a reimbursement for the costs incurred in card production, system configuration, and initial account setup.
3.7.3 Card Cancellation and Asset Handling:
* (a) The Cardholder has the right to apply for cancellation (closing) of their KINGS Card in accordance with the procedures prescribed by the Company.
* (b) The Cardholder may only apply for card cancellation after fully clearing all arrears (including but not limited to overdraft principal, penalty interest, fees, etc.) and settling all pending transactions.
* (c) Once the card cancellation application is finally approved and executed by the Company, all payment functions of the card will be permanently terminated.
* (d) Upon card cancellation, if there are remaining assets (stored value balance) in the KINGS Card Account associated with the card, the Cardholder may apply to transfer the assets to another valid account designated by them within the Company's system and verified by the Company, in accordance with the Company's then-effective rules and procedures. The Company does not guarantee support for transferring assets to third-party accounts or institutions outside the Company's system.
* (e) The Company reserves the right to charge reasonable processing fees for card cancellation and asset transfer services, with specific fee standards subject to those published on the website or mobile application.
3.7.4 The validity of this Clause is independent of the card's expiry date. Even if the card expires, the Cardholder must still comply with the relevant provisions of this Chapter regarding fees, repayment of arrears, and card cancellation.
4 Purchase and Top-Up of the KINGS Card
4.1 The KINGS Card must be registered, reviewed, and purchased through the mobile application.
4.2 A Cardholder may hold a maximum of 5 KINGS Cards at the same time; separate rules apply to corporate applications.
4.3 After purchasing the KINGS Card or before using it, the Cardholder must log into the KINGS Account via the mobile application to activate it, set a login password and transaction password, bind a mobile phone number, and complete the first top-up.
4.4 The KINGS Card can be reloaded repeatedly, but different types of KINGS Cards have different top-up limits (for details, refer to the Fee Schedule).
4.5 The Cardholder shall log into the KINGS Account after each top-up to verify that the top-up amount and stored value are accurate.
4.6 Wallet services (including associated remittance services) are provided by third-party service providers. The Company shall not be liable for any related liabilities when the Cardholder uses such services, but KINGS UNITED will assist the Cardholder in following up on any transaction disputes (if any).
5 Usage of the KINGS Card
5.1 KINGS cards can be used at any terminal worldwide that accepts VISA, Mastercard, or UnionPay International as a payment method (or other terminals that the Company announces from time to time), including websites and ATMs.
5.2 When using a physical KINGS Card for signature-based transactions, the Cardholder must present the KINGS Card and sign the transaction receipt with the same signature as that on the back of the KINGS Card.
5.3 When using an ATM, the Cardholder must enter the pre-set password. If the Cardholder enters an incorrect password at the ATM, the transaction instruction will be rejected.
5.4 When using the KINGS Card for a transaction, the Cardholder must ensure the KINGS Card has sufficient funds.
5.5 The transaction amount will be deducted from the KINGS Account immediately/timely after each transaction is confirmed. Once confirmed, transactions cannot be canceled.
5.6 If the KINGS Account has a negative balance, the Cardholder must immediately replenish the shortfall. The Cardholder shall bear all risks and liabilities (e.g., penalty interest).
5.7 Overdraft, Arrears, and Default Handling
5.7.1 When using the KINGS Card for transactions, the Cardholder must ensure that there are sufficient funds in the KINGS Card Account. Any transaction that causes the account balance to fall below zero constitutes an overdraft.
5.7.2 In the event of an overdraft, the Cardholder must immediately deposit sufficient funds into the KINGS Card Account to clear all arrears. All penalty interest, administrative fees, and recovery costs (as defined in Clause 5.7.5) arising from the overdraft shall be borne by the Cardholder.
5.7.3 When a low account balance or overdraft is monitored, the Company will send a notification to the email address reserved by the Cardholder. The notification is deemed to have been delivered once sent.
5.7.4 If the Cardholder continues to conduct any transaction that causes new arrears or expands the overdraft after receiving the above notification, such conduct constitutes a material breach/default.
5.7.5 In the event of a material breach as described in Clause 5.7.4, the Company has the right to unilaterally take one or more of the following measures without further notice to protect its rights and interests:
* (a) Immediately suspend (stop payment) all transaction functions of the Card;
* (b) Permanently terminate (cancel) the right to use the Card and close the related account;
* (c) Pursue recovery from the Cardholder in accordance with the law, requiring immediate repayment of all arrears, overdraft principal, accumulated penalty interest, and all reasonable expenses incurred by the Company for realizing the creditor's rights (including but not limited to legal fees, litigation fees, travel expenses, and collection fees, etc.);
* (d) Provide the Cardholder's default data to credit reference agencies, financial regulatory agencies, or legally established credit information databases;
* (e) Take all other remedies permitted by law.
5.7.6 The Company's exercise of the rights described in this Clause does not exempt the Cardholder from any other liabilities under these Terms and Conditions and applicable laws.
6 Fast Payment System Services
6.1 The Company provides fast payment system services to enable Cardholders to make payments via the fast payment system. The fast payment system is provided and operated by the Clearing House.
6.2 The Company reserves the right to formulate or modify the scope and terms of use of fast payment system services from time to time. The KINGS Card can receive funds transferred via fast payment system services (for details, refer to the Fee Schedule).
6.3 For any payment or fund transfer, once the Cardholder issues an instruction to the Company, the instruction and the transaction conducted pursuant to it are final, irrevocable, and binding on the Cardholder.
6.4 Instructions issued by the Cardholder to the Company are irrevocable and binding on the Cardholder.
7 Application for Renewal of the KINGS Card
7.1 The KINGS Card ceases service on the expiry date indicated on the card. The Cardholder may submit a renewal application upon expiry and provide identification and related supporting documents.
7.2 If renewal is successful, the original KINGS Card number will no longer be reusable and will be replaced by a new card number. The stored value in the original card will be automatically transferred to the new card number and can continue to be used.
7.3 If the Cardholder fails to successfully renew the Card before the end of the Renewal Application Period, the KINGS Card will cease service on the expiry date.
